Dalit's Islam Conversion

DALIT   ONLINE

Editor: Nagaraja.M.R.. Vol.15..Issue.53.........26  / 12 / 2019

3000 Dalits Will Convert to Islam

The mass conversion comes after a number of cases of caste discrimination including the Mettupalayam wall collapse, and the killing of Dalit youths like Ilavarasan, and Shankar.

Close to four decades since the '1981 Meenakshipuram conversion', around 3000 members of the Scheduled Caste in the state are planning to convert to Islam over government apathy in the recent caste wall collapse. Close to 3000 individuals, who belong or are linked to the Tamil Puligal Katchi, a Dalit political outfit, will be converting to Islam in multiple phases from January 5.
The decision was announced by the party at a state level meeting in Mettupalayam in Coimbatore district and comes after the collapse of a 'caste wall' in the region that led to the death of 17 Dalits. On December 2, a 20-feet high wall built by a caste Hindu, without adequate safety measures, collapsed on a row of houses where Dalits resided in Nadur village. Their deaths came despite multiple protests in the past against the wall, which was essentially seen as a way to keep them separated from the dwelling of the caste Hindus.
"This was the last straw," says General Secretary of Tamil Puligal Katchi M Ilavenil. "Our lives have no value in this religion and if they don't want Dalits, we don't need them," he adds.

To add to his anger, his party President Nagai Thiruvalluvan who was amongst those who protested against the discrimination, continues to be jailed.
"The man who built this wall with no support pillars - Sivasubramanian, is out on bail 20 days after the death of 17 Dalits," points out Ilavenil. "But our leader remains in jail and the rest of us who protested were lathi-charged and multiple cases have been filed against us," he adds.
And amongst those who were lathi charged and booked for protesting is 35-year-old Rangaraj, a driver by profession. A member of the political outfit, he will be amongst the 100 persons converting first on January 5.
"We have been oppressed and beaten by discrimination our whole lives," says the resident of Annur in Coimbatrore district. "Even when we are Hindus, we are not treated like it. In my village, we are not allowed into the temple and we are not given equal access to the government burial ground. And now, after the Nadur incident, I have been booked for unlawful assembly, assault and damage to public property. All this because I stood up against caste discrimination. This religion has done me no good. I don't see the point of being a part of it," he adds.
Rangaraj is yet to tell his parents, who are very religious, about his decision. But he shared the news with his wife, who has been supportive.
"My wife said my son and I can first convert and she and my daughter will do it later. My son is 10 and my daughter 14. I believe that by converting, I can give them a future that we didn't have - one where you are treated like an equal human being," he says.
According to Ilavenil, most people who are converting are party members and their families. Members from a total of five districts including - Coimbatore, Erode, Tirupur, Namakkal and Salem will be converting. The outfit has 120 members in every district, who will take part in the exercise with family.
Shiva, a resident of Mettupalayam will be converting in January with his wife and two daughters who are aged 23 and 21.
"Even my relatives are supportive of this move. We have seen enough - from Ilavarasan to Shankar and now the caste wall," he tells TNM, referring to caste killings that have shaken Tamil Nadu. "Yes, this is not the first time Dalits are converting, but nothing has changed and we feel we have no choice," he adds.
The last time a significant number of men and women from the Scheduled Caste converted to Islam, was in 1981. The village of Meenakshipuram in Tirunelveli district saw 200 families convert to Islam, due to continuous discrimination and caste violence in the village. Similarly, in Ramanathapuram district, 100 families converted to remove themselves from the caste stigma imposed by Hinduism.
And while right-wing groups alleged that Muslim countries were pumping in money to convert Hindus, those involved in the process stated that it was to escape the caste system.
"History will keep repeating itself if caste Hindus do not change how they treat the oppressed castes," says anti-caste activist Kathir. "They move to another religion because they do not benefit from being Hindus. Leave benefit, they are not even given equality or equal access to resources. Dr Ambedkar himself told Dalits to not remain within the clutches of Hinduism," he adds.
And why have they chosen Islam?
"Muslims don't believe in caste," says Ilavenil. "Over the years, they have supported us in our fights and struggles and treated us as equals. We have grown up around Islam and understand the culture. We do not have the same connection with Buddhism. So, we have chosen to become Muslims."

Untouchability Walls keep rising and falling in Tamil Nadu
 By    Subhash Gatade

BR Ambedkar wrote in Annihilation of Caste that “…the world owes much to rebels who would dare to argue in the face of the pontiff and insist that he is not infallible. I do not care about the credit which every progressive society must give to its rebels. I shall be satisfied if I make the Hindus realize that they are the sick men of India, and that their sickness is causing danger to the health and happiness of other Indians.”
In 2008, Uthapuram, a village in Madurai, Tamil Nadu, had made national headlines. It was the year when the Karunanidhi-led DMK state government had taken the initiative to demolish a portion of a thirty-metre wall that had been raised by the dominant Pillaimar community, an OBC caste which had wanted to keep residents of the Devandra Kula Vellalar community, which falls under the Scheduled Caste category, out of the Mariamman temple.
Built in 1989, this wall had become a symbol of segregation based on caste and organisations like Tamil Nadu Anti Untouchability Front, along with other groups and individuals had been conducting agitations to end this discrimination. Finally, the DMK government was forced to take action.
This was perhaps the first time that the rest of India came to know about the prevalence of this pernicious practice in Tamil Nadu. The demolition of the wall was projected as a significant step to move towards caste annihilation.
The recent death of 17 dalits in Mettupalayam wall collapse, in which members of the arunthathiyar dalit caste lost their lives is a reminder of how our celebrations were premature. And that when it comes to caste and its attendant exclusions and discriminations, India still has miles to go.
In fact, in August this year there were reports in the media about another village, P Subbulapuram in Madurai, where an 800-metre “untouchability wall” had been built, allegedly by elite-caste Hindus, and how it had deterred the movement of dalits, confining them from three sides. The said wall had also blocked flow of sewage from their homes.
The immediate trigger for this disclosure was the death of V Shanmugavel, 50-year-old from the village, and the inability of his family to conduct his last rites because the cremation ground meant for dalits, which did not have a shed, was inundated due to the rains. Their requests to the elite castes to allow them to cremate the deceased on ‘their’ cremation ground had led to a furious reaction.
The dalits were forced to use petrol to cremate Shanmugavel’s body, and anti-untouchability activists had told the media about the great chasm between the claims of the state about having “eradicated untouchability” and the system of dual cremation grounds which still exists.
A similar case of discrimination was reported from a village in Vellore, when “members of the dalit
community lowered a dead body from the top of a bridge using ropes allegedly after members of upper-class community denied them access to the common burial ground.”
Undoubtedly, Tamil Nadu, a state which prides itself on its more than hundred-year-old history of anti-caste struggle and social reform, and which seemed a pioneer in this arena, today appears to be a pale shadow of itself. What happened to anti-Brahminical struggle, the espousal of atheism by a section of its leadership and the painstaking effort of a battery of social reformers? The state has always played up its social reform legacy, for example, the legendary Jyothee Thass, writer, journalist, social reformer, Buddhist Scholar and Siddha Physician who was born in 1845 in a paraiyar family is considered a pioneer of not only the anti-Brahmin movement but the Dravida movement as well. Or Rettamalai Srinivasan, who went to Round Table Conference in the early thirties, MC Raja, Periyar Naicker and several others.
One of India’s most industrialised states, which has taken the lead in implementation of the reservation policy, and in which the dalits account for a fifth of the over seven crore population, their struggle still goes on.
A few years back. C Lakshmanan, then assistant professor at the Madras Institute of Development Studies, had organised a seminar to look at the history of various commissions which have been set up to look into cases of dalit atrocities. He found that not a single person had been punished for atrocities against dalits in the last 70 years, though a dozen or so enquiry commissions have been set up. Not even one member of these commissions belonged to a dalit social group.
The NGO, Evidence, has recorded that dalits are not allowed to enter temples in 12 districts, and a number of dalit panchayat leaders are not allowed to function. Also, that 460 tea-shops in Madurai still follow the ‘two-tumbler system’.
The deep-rooted caste prejudice was best underlined at the time of the tsunami, when dalits were discriminated against by the backward castes, though both the social groupings were caught in the same situation.
With the passage of time, another complexity has got added to the issue; the discriminatory walls. These are being raised not just by caste Hindus against dalits but even in areas populated by castes categorised as Scheduled Castes. For example, in village Santhaiyur in Madurai, paraiyars raised such a wall against arunthathiyars, the ‘lowest’ among the dalits in 2013. This wall was demolished in 2018.
The paraiyars are those whose traditional caste occupation was to beat drums, and arunthahtiyars are leather workers, or sweepers and scavengers in Tamil Nadu, Kerala and Karnataka.
Commenting on this discrimination, Ravichandran Bathran, the founder of Dalit Camera, a YouTube channel said, “Caste Hindus used to term dalits as untouchables, carcass eaters and menial workers. This normalisation has now been adopted by paraiyars over arunthathiyars. In santhaiyur, this was what happened. paraiyars started to act like upper caste and arunthathiyars became the victims. Pallars have land and money and the paraiyars have strong leadership but both these factors are lacking in the case of arunthathiyars.”
The class conflict implicit in such incidents cannot be denied. In fact, within dalit communities a section has surged ahead, benefitting from various affirmative-action programmes, while a large majority has lagged behind.
Unless we question the caste system itself, we cannot find a solution to these atrocities. But we are questioning only the atrocities and not the root cause.
In November 2012, three dalit colonies of Natham, Kondampatti and Annanagar in Naikkankottai, Dharmapuri district, Tamil Nadu, had faced organised attack at the hands of vanniars, a dominant backward caste in the region because of the news that Ilavarasan, a young man from the arunthatiar community had married a vanniar girl. Under tremendous community pressure, the woman returned to her mother and Ilavarsan, hoping against hope that she would return, died an unnatural death.
The Economic and Political Weekly journal had written on this issue in July 2013, in Fighting Caste Fighting Patriarchy, raising two important points. “The limiting of social justice to identity assertion has seen the continuation of age-old caste antagonisms, rather than their gradual erosion. It is tragic and ironic to witness the revival of such fatal casteism in a state which pioneered powerful anti-caste movements in south Asia.” Secondly, “Ilavarasan’s tragic death is an indication that progressive forces need to come out more forcefully against the intermeshing of caste and patriarchy. Whether it is the middle-class families of India’s growing cities, or the Khap panchayats of rural north India or criminal politicians, it is becoming clear that caste cannot be fought without fighting patriarchy.”
No doubt, the struggle to eradicate caste or doing away with untouchability needs new ideas, new initiatives and a determination to make mountains move. Tamil Nadu’s experience goes to show that a progressive past is no guarantee that your present or future does not get marred by an utterly regressive turn.
Perhaps one need to pay attention to how Dr Ambedkar viewed the situation, again in Annihilation of Caste. “…breaking up of caste amongst the Hindus is well-nigh impossible. At any rate, it would take ages before a breach is made. But, whether the doing of the deed takes time or whether it can be done quickly, you must not forget that if you wish to bring about a breach in the system then you have got to apply the dynamite to the Vedas and the Shastras, which deny any part to reason, to Vedas and Shastras, which deny any part to morality. You must destroy the religion of the shrutis and the smritis. Nothing else will avail. This is my considered view of the matter.”

It is the duty of Supreme Court of India to Protect , Guard the constitutional rights , fundamental rights of every Indian citizen . Since 25 years  I am  appealing  to SCI  about  issues concerning public welfare , national security , etc and as a result suffering injustices , my constitutional rights , human rights are repeatedly violated  but SCI is mum even when repeated appeals were made to it. Paradoxically , after these appeals for justice , I have suffered more injustices , attempts on my life were made ,  physically assaulted , livelihood  / jobs were  denied , news publication closed , press accreditation denied ,  received threatening  calls , blank calls, even to date  rough elements follow us , rough elements  scout  near home at mid night. Does  not these indicate some ties between rough elements & SCI  Judges ?

Public Interest Litigation is an appeal  for justice  to the courts , to redress  the injustices meted out to  the public.  Individual cases of injustices  pertaining to an individual are not covered under PIL, however  an individual an activist  who  is fighting for public causes  suffering  injustices  as a result of   his struggle  ,caused by powers that be to silence him  can club  his individual case under the public causes  (PIL ) he is  appealing.

Nowadays people of questionable character , integrity  are being selected to public posts , end result is present day india.  In the following web sites I have shown  few actual cases of crimes by judges & police , just imagine what type of justice common man gets.

Traitors  in   Indian  Judiciary & Police
https://www.scribd.com/document/329980170/Traitors-in-Judiciary-Police

Crimes  by  Khaki
https://www.scribd.com/document/334590032/Crimes-by-Khaki     ,

Police show full bravery , courage , use  full might of law while acting against innocents , commoners. Even  takes suo motto action. Frequently crosses legal limits  while acting against commoners like 3rd degree torture , arrest / search  , seizure without warrant , arrest in mid night , etc . While they are supposed to take action against rich crooks , their own corrupt colleagues  no suo motto action , delayed action inspite of complaint  allowing time for rich crook to get anticipatory bail , no 3rd degree torture on him , no arrest , search , seizure without warrant. Where is the bravery , courage of police ?
Judges show their full wisdom , apply rigid law book while  judging cases of commoners , take suo motto action  where as  cases involving rich crooks comes before them inspite of repeated PILs they don’t consider it , let alone take suo motto action. Judges make far fetched interpretations of law , ultimately benefitting the rich crook. Where is the wisdom of Judges ?

I ,NAGARAJA.M.R. hereby do declare that information given above are true to the best of my knowledge & belief. If i am repeatedly called to police station or else where for the sake of investigations , the losses i do incurr as a result like loss of wages , transportation , job , etc must be borne by the government. prevoiusly the police / IB personnel repeatedly called me the complainant (sufferer of injustices) to police station for questioning , but never called the guilty culprits , rich crooks , criminals even once to police station for questioning , as the culprits are high & mighty . this type of one sided questioning must not be done by police or investigating agencies . if anything untoward happens to me or to my family members like loss of job , meeting with hit & run accidents , loss of lives , death due to improper medical care , etc , the jurisdictional police together with above mentioned accussed public servants will be responsible for it. Even if criminal nexus levels fake charges , police file fake cases against me or my dependents to silence me , this complaint is & will be effective.

Powers that  be , higher ups have referred all my previous cases to police although in most of the cases  police don’t  have jurisdiction over it.  It  sends  a subtle message by police force to  the  complainant  to keep silent . In the remaining cases  which are under their jurisdiction police  don’t act against higher ups , high & mighty. In such cases police lack  practical powers , their hands are tied although they  are  honest.  As a end result , police  have repeatedly called   me to police station  number of  times  ( have never called guilty  influential persons even once)  took  statement  from  me and closed  the files.  Hereby , I do make it clear  the statements made by me  in my original petitions , PILs , news papers  , etc  while I was in  a free & fair atmosphere  are  TRUE  , over rides , prevails over all the statements made by me before police  earlier and  which will be made by me  in future before police.

If I or my family members or my dependents are denied our fundamental rights , human rights , denied proper medical care for ourselves , If anything untoward happens to me or to my dependents or to my family members - In such case Chief Justice of India together with the jurisdictional revenue & police officials will be responsible for it , in such case the government of india is liable to pay Rs. TWO crore as compensation to survivors of my family. if my whole family is eliminated by the criminal nexus ,then that compensation money must be donated to Indian Army Welfare Fund. Afterwards , the money must be recovered by GOI as land arrears from the salary , pension , property , etc of guilty police officials , Judges , public servants & Constitutional functionaries.

Legal  Notice  to  Honourable Chief Justice of India

To,
Honourable Chief Justice of India,
SUPREME COURT OF INDIA,
New Delhi.

Honourable Sir ,

Subject : Legal Notice to Chief Justice of India

Are  Judges , Police  PERFECT ? Satya Harishchandra ?

Hereby , I challenge Chief Justice of India  in the exercise of my FUNDAMENTAL DUTIES  as a citizen of india , that subject to conditions  I will  legally prove the crimes of  few  judges , police , public servants within  the government service and other  criminals.  Is the CJI ready  to book those criminals , traitors , anti nationals ?

Since 29 years I am appealing to apex court for justice concerning various public issues , no justice in sight but injustices meted out  one after another. But the same  judges are  SHAMELESSLY  taking huge pay perks for years.  Parasites  feeding  on  Indian  Public. Whenever questions of accountability are asked  judges level contempt charges  against  the  questioner  or police  fix  him in  fake cases or he is silenced by threats , murders , denial of jobs , etc.

Since 29  years  in many  ways they  are trying to silence me. Just take the recent example of Justice Karnan  who leveled corruption  charges  against specific judges  with CJI. Instead of  conducting a fair investigation into the matter , CJI  tried to silence him by  serving  him contempt notice.

Our Judges , Police are  NOT  Perfect  Not Satya Harischandras . There are  criminals  as well as honest people  side by side  in  judiciary & police.  We  whole heartedly respect honest few in judiciary , police & public service. But  we  detest  corrupt  judges , corrupt police. Honest  Judges & Police are not coming into open to  prosecute their corrupt colleagues,  why ? silenced ?

Criminalization of  all wings of government has taken place , unfit people  are in the positions of power. Corruption in judiciary , police , CBI , CVC , Public service is rampant. Now MAFIA is at work.  Only few scandals , scams become public , many  are buried. If one criminal public servant is caught  other public servant who is also a criminal conducts name sake investigation , gives  report , clean chit. Law courts rely on the government reports as evidences , courts are not bothered about credibility of reports or investigations. It is quid pro quo. Therefore technically criminal public servants are never proved for their crimes & convicted , as investigation itself is not fair.

A Crime may happen without the knowledge of police  but  cann’t  continue for years without the connivance of police.  A  Crime reported to court  cann’t  continue  for years without  connivance of judges.

At the bottom  of  the paper , I have given web sites about  few  ACB raids on government officials  and unearthing of crores worth property.  How they have earned it , by misusing their official positions. Therefore  government reports , records  prepared by these officials , investigations conducted by  corrupt police  are suspect.  But  Law courts in various cases , considers government reports , records  , statements of government officials as sacrosanct . Therefore  in many cases  injustice is meted out by court  , as they depend on  reports of corrupt government officials , corrupt police.

The public servants & the government must be role models in law abiding acts , for others to emulate & follow. if a student makes a mistake it is excusable & can be corrected by the teacher. if the teacher himself makes a mistake , all  his students will do the same mistake. if a thief steals , he can be caught  , legally punished & reformed . if a police himself commits crime , many thieves go scot-free under his patronage.  even if a police , public servant commits a crime , he can be legally prosecuted & justice can be sought by the aggrieved.  just think , if a judge himself that too  of apex court of the land  himself  commits crime - violations of RTI Act , constitutional rights & human rights of public  and obstructs the public from performing their constitutional fundamental duties , what happens ?

"Power will go to the hands of rascals, , rogues and freebooters. All Indian leaders will be of low calibre and men of straw. They will have sweet tongues and silly hearts.  They will fight among themselves for power and will be lost in political squabbles . A day would come when even air & water will be taxed." Sir Winston made this statement in the House of Commons just before the independence of India & Pakistan. Sadly , the  forewarning of  Late Winston Churchill  has been proved right by  some of our  criminal , corrupt people’s representatives , police , public servants &  Judges.

I don’t know whether secretariat staff of CJI office & DARPG / DPG officials are forwarding my appeals for justice , e-mails to you or not. They will be held accountable for their lapses if any. This notice is against the repeated failure of constitutional duties & indirect collusion with criminals by previous CHIEF JUSTICEs OF INDIA. Notice is served against them , to the office of CJI , NOT personally against you.
Please refer my appeal for justice through DARPG ;

In india democracy is a farce , freedom a mirage. the most basic freedom RIGHT TO INFORMATION & EXPRESSION , is not honoured by the government,as the information opens up the crimes of V.V.I.Ps & leads to their ill-gotten wealth. The public servants are least bothered about the lives of people or justice to them. these type of fat cats , parasites are a drain on the public exchequer . these people want ,wish me to see dead , wish to see HUMAN RIGHTS WATCH closed . so that, a voice against injustices is silenced forever , the crimes of V.V.I.Ps closed , buried forever.

To my numerous appeals , HRW’s appeals to you ,you have not yet replied. It clearly shows that you are least bothered about the lives of people or justice to them .it proves that you are hell bent to protect the criminals at any cost. you are just pressurising the police to enquire me ,to take my statement, to repeatedly call me to police station all with a view to silence me.all of you enjoy “legal immunity privileges” ,why don’t you have given powers to the police / investigating officer to summon all of you for enquiry ?or else why don’t all of you are not appearing before the police voluntarily for enquiry ?at the least why don’t all of you are not sending your statement about the case to the police either through legal counsel or through post? you are aiding criminals ,by denying me job oppurtunities in R.B.I CURRENCY NOTE PRESS mysore , city civil court ,bangalore , distict court , mysore ,etc & by illegally closing my newspaper. Even  Press  accreditation  to me as a web journalist is denied till date.  there is a gross, total mismatch between your actions and your oath of office. this amounts to public cheating & moral turpitude on your part.

1.you are making contempt of the very august office you hold.
2.you are making contempt of the constitution of india.
3.you are making contempt of citizens of india.
4.you are sponsoring & aiding terorrism & organized crime.
5.you are violating the fundamental & human rights of the citizens of india and of neighbouring countries.
6.you are violating & making contempt of the U.N HUMAN RIGHTS CHARTER to which india is a signatory.
7.you are obstructing me from performing my fundamental duties as a citizen of india.

8. As a result of your gross negligence of constitutional duties you have caused me damages / losses to the tune of RUPEES TWO CRORE ONLY.
9. You are responsible for  crime cover ups mentioned in my RTI Appeals , PILs and continuation of those crimes unabated.
10. You are  responsible  for denial of information,  which  vindicates the crimes of powers that be.
11. You are responsible for physical assaults , murder attempts on me.
12. You are responsible for  job denials to me at NIE , PES Engineering college , RBI Press , Mysore , Bangalore Courts.
13. You are responsible for my  illegal retrenchment from RPG Cables ,  denial of  medical care to  me towards occupational  health  problems.
14. You are responsible for denying me legal aid.
15. You are responsible for illegal closure of my news paper.
16. You are responsible for  denial of press accreditation  to me as a web journalist till date.
17. You are responsible for repeatedly  passing on my appeals to police. So that  they can  take  statements , close the file under the threat of police power.
18. You  have violated my Human Rights & Fundamental Rights.
19. In terms  of  Integrity , Honesty  You & other public servants are  nowhere near  Baba Saheb B R Ambedkar , Mahatma Gandhi  &  Satya Harishchandra . Many Public servants are  UNFIT to be in their posts.

You are hereby called upon to Pay damages to me and SHOW-CAUSE within 30 days , why you cann’t be legally prosecuted for the above mentioned crimes . If you don’t answer  it  will be admission of the  charges  by you.   It will amount to confession of crimes on your own.

If i am repeatedly called to police station or else where for the sake of investigations , the losses i do incurr as a result like loss of wages , transportation , job , etc must be borne by the government. prevoiusly the police / IB personnel repeatedly called me the complainant (sufferer of injustices) to police station for questioning , but never called the guilty culprits even once to police station for questioning , as the culprits are high & mighty . this type of one sided questioning must not be done by police or investigating agencies . if anything untoward happens to me or to my family members like loss of job , meeting with hit & run accidents , loss of lives , etc , the jurisdictional police together with above mentioned accussed public servants , Chief Justice of India & Jurisdictional District Magistrate will be responsible for it. SCI Hand maiden of Government ?

DALIT   ONLINE   –  e  News  Weekly
Spreading the light of humanity & freedom
Editor: Nagaraja.M.R.. Vol.15..Issue.52.........22  / 12 / 2019

Supreme  Court  of  India  -  Hand maiden of Government  ?

Dear Honourable Chief Justice of India,

Indians have lost faith in judiciary because we are ruled by power, not by law
The custodial killing of Hyderabad rape-murder accused and its celebration shows India is in a crisis. Such fast-track ‘justice’ directly challenges your authority.

Sir, nowadays  people with connections get favorable interpretations of law &  justice. Whenever  it is suitable for them judiciary  even takes suo motto action. However a poor commoner  suffering repeated injustices  , physical assaults , murder attempts  doesn’t get justice even after two decades.

Supreme court of India has ample time to adjudicate  cases relating to movies , lotteries ,  other trivial issues  however they don’t have time to  admit , adjudicate  PIL  cases relating to  national security , human rights violations of lakhs of people , looting of government property , is it not a SHAME ?

Judges take hefty salary & perks at public expense , but forget public duties.  Judges  preach  transparency to others while they themselves don’t honour RTI applications seeking  information regarding misconduct, crimes  of judges. Thereby CJI & other SCI Judges are  covering up the crimes and are parties to the crimes.

Judges  serve notices to commoners  in a case  to answer without fail , ask question during  hearing / cross examination  fine. But why Judges don’t answer  Show cause notices served to them & open Interrogation questions to them.

Judges  falsely  presume  they are  above law & practice double standards. Please read the following web pages and publicly answer :

Since independence of india  for seven decades one political party has appeased minorities, backward people  by suppressing  majority community. Now another political party is  trying to suppress the pampered minorities now  to give back rightful place to majority community. This is the reason for current  protests against CAB.  Both political parties are wrong. Our constitution  treats every body as equals irrespective of religion , caste , region , etc. Urgent need of the hour is  enactment of Uniform Civil Code.

All along since independence Supreme Court of India  played to the tune of  party in power  eventhough gross fundamental / Human rights violations of crores of Indians were taking place. Motto for SCI  Salary first duty least. One more need of the hour is transparent selection of judges & accountability of judiciary  to public.

I write to you as a believer in the extraordinary moral enterprise that is the Republic of India. I have always believed that our republic presents the best hope for the well-being and development of all its citizens. I have always argued that “frequently imperfect application, repeated attempts at its perversion and creeping cynicism about its effectiveness must not prevent us from recognising that the Constitution of India offers an enlightened way for us to organise our society and ensure the greatest welfare of all citizens.”

Sir, the custodial killing of accused rapist-murderers by the Hyderabad police suggests that the Republic itself is in crisis. Not only because of what the police officers did, but because of the widespread public approval of their action. From Parliament to casual conversations, from national celebrities to auto-rickshaw drivers, we found open calls for the accused to be put to death. There was no mention, no patience, no faith in due process of law.

To me, this suggests that a large number of Indians have lost faith in the judicial system. They had started developing a creeping cynicism towards the police and the law enforcement machinery of the state a long time ago. But now, their cynicism extends to the judiciary, including the highest courts of the land. If people could expect that criminals would be apprehended, prosecuted and punished in a reasonable period of time, they would not so readily approve of rough and ready measures in the name of justice. By demanding the killing of the accused, and applauding the police after the deed was done, people have revealed what they really think of our formal judicial system.

They do not think it works.

Sir, the Preamble of our Constitution declares that justice is the first thing that the state seeks to secure. Yet, it appears now that power is all that matters. The poor and the weak cannot even get an FIR registered at a police station while the rich and powerful can occupy high public office. The weak can be bumped off by the state while the privileged can set up independent states on private islands. The rich can avoid arrest but the poor languish in prisons for years as undertrials. Cases can be withdrawn when criminals acquire power, so acquiring power seems to be the best defence against legal charges of any kind. To any neutral observer, sir, it is clear that we are ruled by power, not by the rule of law.

It is unfair to blame the judiciary for all this mess. The police force in most states lacks the capacity to conduct reliable investigations and the prosecution is both under-resourced and overstretched. Yet, a part of it is indeed the fault of the higher judiciary. We know that you and your colleagues on the bench are overstretched, under massive workloads, and work under severe constraints.

But by entertaining absurd petitions, legislating from the bench, intervening in the executive domain, and succumbing to popular opinion, you have not been able to stand as the unflinching upholder of the Constitution. Despite being aware of the judicial backlog in the higher judiciary and the reasons for it, you have not initiated any reform to make justice delivery speedier and more efficient. There are civil society groups with the expertise and resources who are ready to help you with this, but you are too preoccupied to utilise their services.

When politicians promise “fast track” courts and order the police to ensure ‘fast track’ justice, they are merely strengthening the public perception that the judiciary is not credible. Justice abhors a vacuum, which is filled by local thugs, khap panchayats, mobs, political leaders and a police force acting outside the law. All these are not only challenging the majesty of the law, they are directly challenging your authority.

It is within your power, sir, to restore public faith in the judiciary, the Constitution and the Indian republic. There are many things that the Supreme Court of India could do. But if you initiate a process to reduce the backlog and set reasonable time limits for the conclusion of new cases, it will send a signal that the judiciary shares the people’s concern. It can galvanise the police, prosecution and the legal community to get their acts together. The process might take a few years, but it is important to take the first step. You, along with the Chief Justices of the various high courts, can help rescue the republic.

Your speech at Jodhpur, sir, makes it amply clear that you are concerned about the problem. The solutions are also known. The Hyderabad police encounter injects an almost existential urgency for action. For the republic’s sake, sir, please act now.

Thank you

Editorial : Contempt of Citizens  by Judges
-Who will  bell the cat ?

Our whole hearted  respect to whole judiciary,  honest few in judiciary,  we want to state  the following: Contempt of Court is used as a weapon by few judges to silence those seeking justice , equality.  While handling a case one  must look at  the issue raised not at the  social status of person raising it. Those persons may be wrong in the mode of presenting the cases , but one must look at the facts , root cause / issue. Judges & senior advocates are also human beings capable of doing exemplary deeds as well as prone to err just like others. There is a false notion that if one makes eloquent quotes , uses Latin lexicon he knows everything. Such people fail to understand and uphold  basic tenets of our constitution , what is the use of their oratory ?

1.Selection of judges is not transparent. Significant number of those selected are  related to seniors in one way or the other. They may be deserving but raises the question “ Are not any fit persons there in the bar who are not related to anybody but deserving ?”

2.A senior advocate by his privilege gets superfast hearing of his case at the cost of a poor litigant represented by a junior lawyer. For example a senior advocate is representing a movie producer in case related  to movie screening he gets priority over a junior advocate representing a person who has suffered police torture or his land grabbing by Mafia,  illegal dismissal from service ,etc. Thereby , Senior advocate & presiding judge will be violating the poor man's right of equitable justice. Due these senior advocates in some cases poor persons represented by junior lawyer are dead by the time of judgement or suffer irreparable loss. Who will bear the cost , responsibility for this injustice senior advocate or presiding judge ?

3.In India  millions of people are barely surviving  on a single piece meal a day, still they pay indirect tax to public exchequer. Judges enjoy  relatively huge salary , perks  still  judges  demanded more pay & perks. Don't they have human conscience  ?

4.Corruption is rampant  in judiciary  just like other wings of government.  This has been affirmed by former Supreme Court Judges themselves.  Therefore all the judgements are not sacrosanct. Some may be and some may not be.

When issue of corruption was raised Justice Karnan was silenced by contempt of Court  weapon , when  disparity  between senior & junior advocates was highlighted  advocate M J Nedumpara was silenced by the contempt of Court weapon. When  inhuman unjustified pay , perks  by high court judges was questioned  meghalaya journalist was Silenced by contempt of Court weapon.  It  clearly proves nervousness of those judges who are caught on the wrong foot.  What is needed is transparency of judiciary , logically looking at the core issue raised. If the way of presenting the case is wrong  punish them but only after settling core issue not by silencing the whistleblower. By silencing whistleblowers those judges are  themselves  making contempt of the  very August office they hold , making contempt of constitution of India  and  contempt of  citizens of India,  what legal punishment for those erring judges ? Who will bell the cat ?

Why The kith And Kin Of Judges Being Mostly Considered For Appointments? Asks SCBA President, If A Judge’s Child Has Calibre, He/She Can Become A Judge: CJI
Excerpt from 2017  article

CJI Khehar also denies his son is on any state government panel

The Independence Day ceremony at the Supreme Court lawns today became a venue of some “polite” exchange between Supreme Court Bar Association President R S Suri and Chief Justice J S Khehar regarding children of judges or retired judges becoming judges and “80% of government panels being filled with sons and daughters of judges.

It all started when SCBA President Suri in his speech while reminding Law Minister Ravi Shankar Prasad and Chief Justice J S Khehar who were on the dais “several matters of concern” said "then there is one issue again an empirical..that why most of the judges who become HC judges are sons of previous judges. Why is that 80% of panels are filled with sons and daughters of the judges? These things are there but some empirical but some logical things have to be there so that we give some chance for other people also to come up the ladder because they are able and capable”

"Why is that the kith and kin of judges have the panels and are being considered for appointment as judges. Time has come that judiciary takes itself a ‘Sankalp Parva’ to clean the system of the 3rd wing, which is the most important  one in upholding the constitutional values", he said.

Please refer my appeal for justice through DARPG ;

Open Letter to Honourable CJI

DALIT   ONLINE   –  e  News  Weekly
Spreading the light of humanity & freedom
Editor: Nagaraja.M.R.. Vol.15..Issue.51.........15  / 12 / 2019

Dear CJI,
Indians have lost faith in judiciary because we are ruled by power, not by law
The custodial killing of Hyderabad rape-murder accused and its celebration shows India is in a crisis. Such fast-track ‘justice’ directly challenges your authority.
Dear Honourable Chief Justice of India,
Sir, nowadays  people with connections get favorable interpretations of law &  justice.
Please read the following web pages and publicly answer :
https://dalit-online.blogspot.com/2019/11/rti-answer-honorable-cji.html?m=1  ,
https://dalit-online.blogspot.com/2019/08/tale-of-2-judges.html?m=1  ,

Thank you
Nagaraja Mysuru  Raghupathi

- Dividing  Indians
It is a shame on our law makers , they are dividing indians on the basis of religion  much against  the   unitary  founding spirit of our constitution. All this happened on  Universal Human Rights  Day  , grossly violating indian's human rights. Citizens must raise to the occasion and legally challenge this inhuman act of  government of india. Our  MPs  are more ruthless than naazis, britishers or islamic fundamentalists. Raise now or perish.
First they  came for the Communists

Letter against CITIZENSHIP AMENDMENT BILL
10th December, 2019
To
The Union Minister for Home affairs
Ministry of Home affairs Government of India
North Block, New Delhi
Sir,
Tabling of the CAB in the parliament and the approval of it in the Lok Sabha marks the darkest day in the history of modern India. Your vehement defence of the bill on the floor of the house revealed a lot about the core ideology of hatred that drives your government. I feel completely ashamed that as a country that we have let down our muslim and Adivasi brothers and sisters and have not succeeded in assuaging their fears about the secular ethos of the country. We have been asking you to understand the larger ramifications of this communal bill and NRC and have been trying in all peaceful methods to convince your government. The passing of this bill in the Lok Sabha has left a deep scar in the belief of already marginalized people and along with the NRC is surely an attempt to profile muslims and adivasis akin to the Asiatic Registration Act in South Africa and the Nurenberg laws of Germany. After hitting deaf ears we have no option other than to start a Satyagraha / civil disobedience against this communal bill(CAB) and NRC .
I for one declare that "I refuse to accept the process of enumeration in NRC by not submitting the requisite documents to prove my citizenship and is willing to accept the action taken by the Indian State for my disobedience. If the state chooses to declare me as a non-citizen I would also be happy to fill up the many detention centers that you are building all over the country". I would accept the incarceration with all humbleness than to wait at the sidelines as a mute spectator to the communal profiling and disenfranchising of my fellow humans.
I am sure that every citizen of this great country who would relate to my feelings would certainly follow the path shown by our father of the Nation in South Africa in fighting a draconian law aimed at dehumanising people for political gain. As a former civil servant I would advise you to increase the capacity of your detention centers, as many of us would fill it up before you succeed in your agenda. In the coming days you would realize that this country is the making of people who would stand up for one another and would fight every attempt by any authority to divide us. You would have to move through some of us who would stand in the front to stall your progress at unleashing atrocities towards the marginalised. So keep your strategy ready . Jai hind.

Human Rights violations by NHRC

DALIT   ONLINE   –  e  News  Weekly
Spreading the light of humanity & freedom
Editor: Nagaraja.M.R.. Vol.15..Issue.49........08  / 12 / 2019

What are Human Rights?
ANSWER: Human rights are standards that allow all people to live with dignity, freedom, equality, justice, and peace. Every person has these rights simply because they are human beings. They are guaranteed to everyone without distinction of any kind, such as race, color, sex, language, religion, political or other opinion, national or social origin, property, birth, or other status. Human rights are essential to the full development of individuals and communities.
Many people view human rights as a set of moral principles that apply to everyone. Human rights are also part of international law, contained in treaties and declarations that spell out specific rights that countries are required to uphold. Countries often incorporate human rights in their own national, state, and local laws.

Answer  Honourable  CJI  SCI , Honourable  Chairman , NHRC &  Honourable  DG & IG of  Police  GOK

To
Honourable Chairman
National Human Rights Commission
New Delhi.

Honourable Sir,

Since 1990 , I as a citizen of India have brought to notice of SCI , NHRC & Police various crimes  hoping for justice to the  suffering public. Supreme court of India has enough time to judge trivial issues concerning movies , cricket , etc  but it doesn’t  have time to judge public  issues concerning national security , accountability of judges , police , public servants  in all these 28 years.  After repeatedly appealing for justice , powers that be have meted out injustices to me personally to silence me. SCI has failed in it’s duties  since 28 years , but judges are taking  hefty pay , perks from our money , public money  without feeling of shame or guilt.

Hereby , I request Honourable CJI , SCI , Honourable Chairman , NHRC & Honourable DG & IG of Police , Government of Karnataka  , to  provide information  by answering  following questions :

Subject : REPLY / OBJECTIONS in Case No. 888/10/15/2014

Following points are my reply / objections to case closure refer your letter dated 18.09.2018. My whole hearted respects to honest few in judiciary , police & public service.

1. Since 1990 how many applications of PIL , RTI are received by SCI , NHRC & Karnataka Police from me  NAGARAJA M R ?
2. How many show cause notices  are served to CJI , SCI  by Nagaraja M R , since 1990 ?
3. Details of action taken in each case. If not why ?
4. Why compensation amount is not yet paid by CJI , SCI or NHRC to NAGARAJA M R , till date ?
5. How CJI , SCI  & NHRC are  going to  protect the lives , civil rights of NAGARAJA M R & his family members ?  If anything untoward happens to NAGARAJA M R & his family members  CJI , SCI  is responsible together with NHRC , jurisdiction police & district magistrate.
6. Why no  criminal legal prosecution of CJI , NHRC Chairman , police , public servants  for their failure of duties ?
7. Honourable CJI , SCI  , Honourable Chairman , NHRC & Honourable DG & IG of Police , Government of Karnataka  read  full case details at following web sites & honestly
ANSWER :
 https://sites.google.com/site/dalitoonline/answer-cji---loya-murder    ,             https://sites.google.com/site/dalitoonline/interrogate-chief-justice ,

8. Statement of police are half truth.
9. Statements / complaints made by me in my e mails / e news paper when I was in free & fair atmosphere holds good forever. It overrides statements made before police.
10. Some of the complaints made by me are pending since years/  decades. Other than police summoning me repeatedly to question me , to take my statements , What else they have done?  Just based on my statements before police , police have filed case closures  subsequently NHRC / SCI   also  followed the  same course.  what other action did they take for years ? Did police , NHRC / SCI summon high & mighty people mentioned in my complaints even once ? Did they take their statements ? Did they conduct investigations? What are the outcome of those investigations ? Did police find out the persons & their motives for silencing me ? Did police police take action against them ? Have police formally requested government & supreme court for sanction to enquire powerful people enjoying legal immunity privileges? If not why ?
11. Fed up with inaction of police for years and understanding their practical difficulties I have appealed to NHRC and Supreme Court of India by way of PILs seeking justice. Till date I have not got justice from NHRC or SCI.
12. Public servants take thousands of rupees salary , perks every month on time without fail from public exchequer. But some of them don't do their duties properly in time. public made to wait for justice indefinitely for years together.
13. Is it not the duty of government to protect life , rights of all citizens and to enable them to perform their duties ? If goverment cannot do it’s  duties  then such public servants are  waste bodies.
14.  Does not the  denial of justice in the above cases  to me  amount to cover up of crimes by police & judges ?
15. I have answered questions of police , IB number of times now it is the turn of police, judges to answer my questions seeking truth. Please read following web pages and answer within six weeks :
https://dalitsonline.blogspot.com/2018/08/torture-of-corrupt.html?m=1

16. In war soldiers  cut off food / medicine supplies to enemy troops to cripple them , to reduce their fighting strength. In the same way my job opportunities in NIE Engineering college mysore PES college mandya RBI Press Mysuru RPG Cables mysuru Mysuru court & Bangalore courts were denied illegally. Who was behind it ?
17. Who behind denying registration to my news paper & denying press accreditation to me ?
18. Who behind physical assaults on me , threats to me , blank calls to me , stalking over my  family ?
19. What action taken against those persons ?
20. I request you for justice , legal prosecution of guilty , legal prosecution of police and judges who by their inaction helped in crimes cover up.
21. As state police are not empowered hereby I request you for a  transparent  SIT probe monitored by NHRC & SCI.
22. Hereby I state if anything untoward happens to me or to my family members dependents NHRC will be jointly liable with CJI , jurisdiction police & District Magistrate for the crime.

23. Why i was not permitted to appear as an Amicus Curie before Jain commission of  enquiry  probing  Rajiv gandhi assassination case ?
24.  I have brought to the notice of SCI  land grabbing of hebbal lake , beml quarters lake, hootagalli lake in the very early stages. Due to your inaction grabbings took place continues till date. Are you not  complicit in the crimes ?
25. Why no proper action taken against management of RPG Cables for their crimes ?
26. Why i was not given legal aid to  pursue my cases in SCI ?
27. If a commoner murders a person it is a crime if the same act done by police is it not a crime ?
28. If a commoner gives a  false statement / false affidavit it is a crime , if the same act done by a judge, police, advocate is it not a crime ?
29. I have given list of crimes  committed  by judges , police , advocates to you earlier  , still no proper  legal action taken against culprits why ? Are the rules , law different for them ?
30. Few  advocates , police  , intellectuals ( ? ) have threatened me over phone , through social media , etc  to silence me. They are nothing but stooges , cronies of corrupt. Why no legal action against them for Obstructing my Fundamental Duties and  for violations of my fundamental rights , human rights ?
31. I have  appealed to SCI regarding  cases of atrocities against Dalits. Till date no proper legal action taken why ?
32. Are not the delays by you amount to denial of justice by way of time bar of case or death of  applicant ?
33. Why SCI has not utilised my services to apprehend criminals within public service ?

Date :  20.02.2019                                          Thank you

Corporate Corruption

The surprising silence on corporate corruption
- Pranjal Sharma

When will corporate India begin to talk about corruption within? When will it begin to address the fraud that business leaders commit against investors, consumers and employees?
Corruption within the government and political system is tackled by a framework of checks and balances. Faulty and undermined it may be, but the framework does expose scams and scandals at regular intervals.
Less regular is news about corporate corruption. Business leaders in India remain surprisingly silent about the corrupt among them. Corporate corruption is of two kinds.
One where business leaders collaborate with rogue government and political leaders to scam the exchequer or get ahead of rivals. This often gets exposed.
The second is where business leaders actively indulge in fraud against their stakeholders. These include the consumers, investors and even employees.
While many would argue that this does not affect society at large, the truth is far scarier. Most companies in India have borrowed from banks and financial institutions. These funds belong to depositors and taxpayers.
So when a company commits a financial fraud it is really stealing the money from investors, depositors or taxpayers. Sometimes from all. Scores of companies have been accused of provident fund frauds. They take money from employees’ salaries but do not deposit it in mandated provident fund. Most get away with it or hush up the matter.
Often the fraud is against consumers. This is the most dispersed category with little or no organized strength.
Corporate India wants to believe that there is corruption everywhere except within itself. It is a rare business leader who discusses corporate corruption openly. Most are part of the millionaire society that has personal and filial links with each other.
As a result, none speaks against the other.
Industry bodies that are shrill about governance, tax and interest rate matters, remain quiet. I can’t recall a conference organized by any domestic Indian industry body that attacked corporate corruption.
There was a strange silence from corporate India when the Satyam scam was exposed. Leading auditors, consultants and management consultants were implicated along with the promoters of Satyam. Few business leaders spoke up against Ramalinga Raju, the CEO and promoter who was indicted.
A similar silence was noted when the recent Ranbaxy case was exposed. Dinesh Thakur, a US based senior executive of Ranbaxy Laboratories, complained against his own company for falsifying drug data and risky manufacturing practices. He won the case against his company and won $48 million under US law that protects whistleblowers.
Notice also the lack of reaction by corporate leaders against the Sahara Group that has been accused by market regulator Securities and Exchange Board of India of stealing money from depositors. Business leaders tend to look away in cases like and refuse to even acknowledge it publicly.
The Indian system has two problems. One is that law does not protect whistleblowers although a new bill is awaiting approval from parliament. Second is that business leaders refuse to look the problem in the eye.
While legislative changes will take their course, it is time that business leaders begin to look within. Captains of industry have to name and shame peers publicly much in the same way they lament corruption in the government.

Editorial : CORPORATE CRIMINALS /  CORPORATE TERRORISTS /  TAX THIEVES  RESPONSIBLE FOR ALL ILLS IN INDIA

In India , a small shop owner to big industrialist have mastered the art of TAX EVASION . their teachers - some corrupt tax officials & auditors. The black money thus created
is causing inflation, feeding the mafia , underworld. Some industrialists lobby ( bribe ) with the government & gets favourable laws enacted. This black money is the main source of funds for political parties , religious bodies & terrorist outfits.

The recent raids by C.B.I & KARNATAKA LOKAYUKTHA have proved how the tax officials have become multi-millionaires. The sad part is that some of the police officials who are on deputation to C.B.I & LOKAYUKTHA themselves are utterly corrupt.

This scourge can only be cured by corporate accountability intoto. However , all the industrialists , traders who are demanding for more flexible labour reforms , economic reforms , infrastructure , etc are not at all concerned about their own accountability with respect to tax , environment , other laws. The MNCs coming to India are not coming here for best Indian talents or infrastructure alone. In their own countries they are feeling the
heat of strict environment laws , consumer laws , share holder disclosures , corporate accountability. Some of these MNCs are being kicked out of their countries , by it's own people .These MNCs are aware that in India , by greasing the palms environment laws , labour laws , tax laws , etc everything can be flouted , cases in courts can be dragged on for years . share holder disclosures , corporate transparency is minimum.

However when a concerned citizen complains about the crimes of guilty corporates , organizations or corrupt public servants , immediate action is not taken. The file is kept pending for months , years together  , allowing the criminals to manipulate all the evidences , records , ground situations. Finally even if action is taken guilty will be let out due to favorable  evidences , there are chances that the concerned citizen himself is falsely implicated & put behind bars . in all such cases all the involved parties must be subjected to lie detector tests .

Bottomline : development is a must , it must be all around . but not at the cost of majority to make a few richer.
Jai Hind. Vande Mataram.

Your’s sincerely,
Nagaraj.M.R.
